Bay & Bee Membership Agreement

This Membership Agreement (“Agreement”) is between Bay & Bee Inc. (“Bay & Bee”) and the undersigned member (the “Member”).

 

By participating in programs at Bay & Bee I agree to follow all policies and procedures of the facility. I enroll understanding the risks and benefits of physical activity and state that all family members participating are in condition to play. I agree to supervise my child at all times while at Bay & Bee. I agree to allow Bay & Bee to use photos taken of my family for archival and publicity purposes.

1. Membership

Basic membership includes entry for one child under 5 years old and their authorized caregivers.

All memberships will allow each Member use of the indoor play space during business hours. All other services will be charged at the time of registration or booking. All memberships are non-voting and non-proprietary. We encourage membership and full enjoyment of our facilities by all people – we will not discriminate in the granting or revocation of membership on the basis of race, creed, color, religion, sex, sexual orientation, disability, or national origin.

2. Change of Information

The Member shall promptly notify Bay & Bee in writing of any change in address, telephone number, billing information, authorized caregiver information, or emergency contact information.

3. Term

Minimum term for any membership to Bay & Bee is 1 month. The monthly membership contract is set to automatically renew for subsequent months from date of joining and the Annual membership is set to automatically renew for subsequent years, unless canceled by client in writing (email sent to cancellations@baynbee.com), 3 days prior to billing date.

4. Membership Fees

Monthly Membership is $78. Additional sibling fee is $24. Fees may not be refunded under any circumstances. There is a 10% discount for Military. 
 5% discount for annual membership paid up front.


5. Registration Fee

There is no registration fee applied currently 

6. Declined Payments
Declined automatic payments due to any reason will incur a $5 per day fee.

7. Account Hold

You may put your account on hold anytime. You will need to send in written notice with a restart date, at least 3 days prior to your billing date to cancellations@baynbee.com

 

8. Daily Rules and Regulations

  • Member is required to check in with front desk staff upon entering Bay & Bee
  • Children using the play space must be accompanied by their parent/legal guardian or authorized caregiver at all times
  • We require that all adults wear socks to the play area. Cubbies are provided for shoes and belongings
  • For your child’s safety, no food, open container drinks or shoes are permitted in the play area
  • Due to fire safety regulations, Bay & Bee requires strollers to be left outside of the play area
  • Occupancy in the play area is limited to what is deemed acceptable by the Fire Marshall and reasonable by the management of Bay & Bee. We reserve the right to limit the number of children/caregivers that are in the play area at any time. Members acknowledge that such effort is made in order to provide as safe and fun an environment with limited inconvenience as possible.
  • Illness Policy: In consideration of our other members, please keep sick children at home. Parents and children should not return to Bay & Bee after illness, until symptoms have been absent for at least 24 hours. Please refer to the CDC’s website for specific information regarding contagious illnesses, or ask for more information at the front desk. Bay & Bee reserves the right to send a child home to get well. If your child has allergies, please alert a staff member. Bay & Bee does not have a medical staff available and is not permitted to provide emergency or other medical treatment.
  • Animals and items from home: To help provide a safe environment, it is not permitted for any member to bring animals to Bay & Bee. Children are not allowed to bring objects such as toys from home. Transitional objects such as blankets or pacifiers are welcome.
  • Personal Belongings: Any personal belongings brought to Bay & Bee are at the members’ own risk. Bay & Bee accepts no liability for loss or damage to such property. Any property left on the premises and handed in to a staff member will be retained at Lost & Found for 30 days. After this time, the property will be donated or disposed of.
  • Cell Phones: Please do not allow the use of cell phones to detract from your ability to supervise your child
  • Bay & Bee is a gun free area. Please refrain from conceal and carry

9. Maintenance:

In the event of closure of the entire facility for any reason including, without limitation, construction, repair or maintenance for a period exceeding one (1)week, prorated credit will be given such that the membership will be extended for the period of closure. Member expressly waives any other remedy.

During periods of construction, repair efforts, maintenance and special events, Bay & Bee reserves the right to close, limit or restrict the use of its facilities in whole or part in its sole discretion.

10. Class Changes: Bay & Bee reserves the right to cancel programs that are under- enrolled. Bay & Bee also reserves the right to modify classes and faculty as necessary.

11. Revocation of Membership:

At the discretion of Bay & Bee, membership may be revoked at any time, or extension of membership may be denied, in the sole discretion of Bay & Bee, if the Member consistently failed to observe the rules and regulations or has otherwise behaved in a manner contrary to the best interest of Bay & Bee or its members.

12. Disclaimer of Liability:

Bay & Bee is not liable for any harm or loss to persons or property. Any protection exercised or offered by Bay & Bee shall be deemed purely gratuitous on its part and shall in no way be construed to make it liable for any loss or inconvenience suffered by the member. Bay & Bee is not responsible in any circumstances for indirect, consequential or punitive damages.

13. Risk of Illness or Injury: The Member is aware of the risk of illness or injury inherent in any program. The Member and his/her child is participating in Bay & Bee’s programs upon the express understanding that the Member hereby indemnify, waive, and release Bay & Bee, its employees, agents and officers from any and all claims, liabilities, expenses or judgments. 

(a) the Member’s or child’s participation in a program or any illness or injury resulting there from;
(b) exposure of the Member or the Member’s child to any illness or disease while on Bay & Bee’s premises; or

(c) any injury or damage to the person or property of the Member or the Member’s child while on Bay & Bee’s premises. The Member further represents that neither they nor their child will be ill when coming to Bay & Bee and the child will not, to the best of the Member’s knowledge, have been exposed to any contagious disease.

14. Member Responsibilities:

The Member assumes full responsibility for himself/herself and anyone who becomes a Member under this Agreement, including the Member’s children, authorized caregivers or guests and shall indemnify Bay & Bee, its employees, agents and officers against any and all liability incurred by any act of the Member, child, guest, or authorized caregiver. The Member agrees that he/she or their authorized caregiver shall remain on the Bay & Bee premises directly supervising their children at all times.

The Member further acknowledges that Bay & Bee does not have a medical staff available and cannot provide emergency or other medical treatment.

Member’s Right to Cancel. The member may cancel this agreement without further obligation. Notice of cancellation shall be delivered by electronic mail to Cancellations@baynbee.com with subject line “Cancellation”, 3 days prior to next billing date. 

Annual Member Agreement

 Bay & Bee’s annual contract agreement is for 12 consecutive months. Member agrees to pay for 12 consecutive months at the membership level agreed upon at sign up.  Pricing will not change. Member will receive a free birthday party during regular birthday party hours while contract is active. 




Early Termination of Annual Membership 
In case of move farther than 25 miles radius, please provide proof of move and new mailing address. A $35 early termination fee will apply. Member will also repay cost of Birthday Party ($285).

I have carefully read this Agreement, waiver, release and indemnity and fully understand its contents. I also have read, understand, agree to abide by and be bound by all rules and regulations. I understand and agree that any person who is a party to this Agreement will also be a party to this waiver. I acknowledge and understand that by this Agreement, I agree to assume all risks of bringing my child to Bay & Bee and that in the event of my child’s illness or injury I have no recourse against Bay & Bee, its employees, agents and officers.
